Amid growing discontent over political and security conditions in Papua and West Papua, there have been various narratives emerging about Papua’s integration to Indonesia. Some of the narratives have revolved around several key issues: (i) Papua is Indonesia’s colony; (ii) that the 1969 vote was a sham; (iii) a self-determination referendum is required to free Papua; (iv) international community should support the Papua freedom movement.

The legal status of Papua as part of Indonesia has been reaffirmed in the Act of Free Choice referendum (Pepera) in 1969, in which majority of Papuan people voted to join Indonesia at that time. The result of the referendum was also recognized by the United Nations through UNGA Resolution 2504.

Some Papuans have challenged the Pepera, saying that it has contradicted the 1962 New York Agreement. A group called the Coalition of Advocates for Truth and Justice for Papua filed a judicial review petition to the Constitutional Court in 2019, arguing that there was evidence that the Pepera contradicted the New York Agreement since only 1,025 people out of 800,000 Papuans voted in 1969. The court has delivered its verdict, which rejected the said submission since the concerned matter is beyond its authority to examine.

The government has maintained that the Pepera does not contradict the 1962 New York Agreement since the latter does not regulate that the referendum should be held under “one-man one-vote” mechanism.
